Cruz/Grassley Introduce Alternative Gun Bill

Senators Ted Cruz (Texas) and Chuck Grassley (Iowa) introduced an alternative gun bill this morning that would replace the current Senate proposal from Chuck Schumer and would replace the Manchin-Toomey background checks legislation. The proposal is the “Protecting Communities and Preserving the Second Amendment Act.” This Cruz-Grassley proposal would “improve the National Instant Criminal Background Check System, increase resources for prosecutions of gun crime, address mental illness in the criminal justice system, and strengthen criminal law by including straw purchasing and illegal firearm trafficking statutes.”

Grassley put an emphasis on the mental illness part of the bill. “We’ve put together an amendment that can effectively address some of the problems we’ve seen while protecting Second Amendment rights,” Grassley said. “I’ve been very interested in the mental health aspect of this debate, so we include provisions to study and address that issue.”

Sen. Kelly Ayotte (N.H.) announced that she’d be opposing the Manchin-Toomey bill. Ayotte had been a key target for the Manchin-Toomey advocates and with her opposition it will be difficult to marshal 60 votes in favor. She has announced cosponsorship of the Cruz-Grassley proposal today.

Here’s the full summary of legislative provisions:

• Improve and reauthorize grants for NICS database;

• Require federal courts to submit relevant information to NICS;

• Ensure that relevant mental health records are submitted by states to NICS;

• Condition federal grant money for states on their submission of mental health records to NICS;

• Increase federal prosecution of gun violence by establishing the Nationwide Project Exile Program and establishing a high level federal taskforce;

• Study of the causes of mass shootings;

• Responsibly addresses gun violence by criminalizing straw purchasing of firearms and gun trafficking;

• Second Amendment Protections for Veterans;

• Require the Department of Justice to explain to Congress why it has or has not been prosecuting gun cases;

• Place Limitations on Fast & Furious type operations by DOJ;

• Authorize FFL’s to utilize the NICS database to for voluntary background checks of employees;

• Authorize FFL’s to access the FBI’s National Crime Information Center stolen gun database to ensure that a firearm is not stolen prior to acquisition;

• Reauthorize the Mentally Ill Offender Treatment and Crime Reduction Act (MIOTCRA) with amendments;

• Address school safety by Reauthorizes the Community Oriented Policing Services (COPS) Secure our Schools Program through 2023.

    I am still not comfortable with adding mental health data to the background database. The devil is in the details here. What mental conditions would cause someone to be turned away from buying a firearm? How do they get around the privacy of medical records and the Doctor Patient privilege? The rest all seems reasonable, though I don’t really see it as worth the effort, since the current background check and other laws already criminalize most if not all of the behavior. On top of that, anything bad that you can do with a gun is highly illegal already and has been for centuries. People who are committing these crimes won’t have any problem getting around background checks. One more crime on their resume won’t bother them a bit.

      What we need is a law that everyone can own guns but if you use one in a crime you spend the rest of your life in a very bad prison. Make it so bad and for life the only people that would ever use a gun in crime would be a total nut job. Make it so bad that even the gang bangers will throw away their guns. Anything else takes away the rights of everyone else. The 2nd amendment says Shall NOT be infringed upon. ANY law taking away our rights is 110% Unconstitutional. PERIOD!!!!!!!

        There are already a number of laws in place like this, however they are not prosecuting. Instead of more laws we need to enforce the ones already in place. Furthermore it should be that the use of ANY weapon in the commision of a crime is a mandatory 25 years of HARD LABOR. The ACLU has ruined the prison system. They get treated better then I do in my own home. I do not get free cable TV, or a free phone service. I say we revamp the prison system first, making it so that criminals will NOT want to commit the crimes in the first place. Also, the ENTIRE prison system should fall under the DOD instead of the DOJ. There should no longer be any state prisons either, all should be federal facilities run by the military.

I worked maintenance for 10 years with this sleezie bunch of prisons! Work is almost entirely voluntary for most inmates with some exceptions that is!

      As I have noted the limbs are working, actively, with the VA to declare many vets as “incompetent” because a) head injury b) loss of a limb, c) possible PTSD. They then notify the local PD to come and confiscate their guns. Nice, huh?       labillyboy – I believe a mere statement by a mental health professional that a patient under his/her care is a threat to themself or to others should suffice WITHOUT divulging the details of that individual’s particular disorder. That should adequately protect their privacy and insure that they will be denied LEGAL access to a firearm. I am very concerned that everyone’s privacy should be protected and that, should that individual arrive at a point where that threat no longer exists, the mental health professional will be required to so notify NICS.

    I have a gun bill for these guys. Require anyone who votes to own a gun. If you are on public assistance, you can not vote. If you don’t have a job, you can’t vote. If you are a criminal, caught with a gun in the commission of a crime, mandatory 20 year sentence.

      Since it will always be whittled down regardless of any “mandatory” language in the sentencing guidelines.

We can’t just go and kill everyone that breaks the law. your remedy works for me on the guy who raped, murdered and raped again in the same instance and while he was inside, he pumped iron to get more muscles than a body builder and abused and murdered everyone he/she could while inside. Being sentenced to triple life sentences is insane, Someone like that is a proven animal and demonstrated to the nation. Put that mad dog down.

          The reason why it costs 45k/ year to house each one is because they have access to all the things we do out here except for freedom. Cable, cigarettes, sex. you name it. All that should change. Prison is a place no one would want to go to or return to. It should be the definition of hellhole. (Sorry, Jan. no other way to express it). Guards take bribes and look the other way while powerful factions run the prison. These people should be separated into very small cells, not even enough to do a push up in. The ceiling should be close to the bed so that you can’t do a push up while in bed. These men and women should be given enough food to survive and that is it. Surely not enough to body build in order to become a more effective killer. Each prisoner eats in their cell. This would be to prevent inmates from taking other’s food by force. Education? Why? These fellows were not interested in getting educated while they were free. They want to learn now? Our own children are unable to go to college because we can’t afford to send them, I have no desire to pay to buy books so they can teach some monster how to skirt the law the next time he is out.

        Essentially, when you do the crime, you do the time. If you are sentenced to 20 years, you serve 20 years, sentenced life, you serve life, which means you die in prison. Right now they consider life as a 20 year span as I understand it. if you go in at 20, you come out at 40. Plenty of life and anger in you to create the desire hurt people and to commit more crime. Mandatory sentencing will take the power to adjust the time sentenced in the hands of the judge, which too many of them are soft-hearted. Another thing is reducing a sentence because of “Good behavior”, What is that? They could not behave themselves while they were out here with us when it counted, they should not get time off just because they refrained from acting like an animal while inside.

        I do like the concept behind the movie, “Escape from New York” , a maximum security prison on Staton Island. You go in, you never come out. For the killers and the hopelessly violent criminals. Any attempted escapes are met with 1 warning to return to the island, the 2nd warning is you are blown out of the water. There are just too many hardened criminals nation wide who will never get out of prison , ever. To be humane, you air drop supplies, food , fresh water, spiked with mood relaxing drugs. to make the inmates docile. You do have the option to be “Put down” if you do not want to go inside. Just let a guard know you choose this option.

    Sounds pretty good. And studying mental health is a good idea. People who have suicidal tendencies do not need weapons. Most of our vets, while they suffer from stress issues, such as PTSD, are not necessarily ‘mental’. I suffer from stress & anxiety, so take meds for that. But, I don’t own a gun, & know next to nothing about one, so I don’t need one, unless I take some kind of training on how to use it.

However, with our legislature, I would have to actually read a final bill in order to make certain what it does, and does not do, falls in line with the outline in the article above. Never forget, Obama tried to make his Obamacare bill sound reasonable–and, in fact, millions of Americans also thought it did. Sneaking it through without allowing our Senators or Congressmen to either read it, or debate it, sure wound up screwing the pooch, since it has done exactly the opposite of what the Emperor said it would do!

      Unfortunately as soon as they put an Assault ban on weapons the first time, they have already changed it and it set a precedence for more. Even if they pass something that makes sense, it will not be over, they will start playing with that, trying to twist it and turn it in order to try to fashion it into something they can create loophole in to slowly take the guns. We will have to continue to fight them and we will keep fighting them forever. It is why it is so important that we teach our children that these rights exist now so that they will know that if they want to keep them, they will have to fight for them too when we are all gone.

    The PROBLEM is that ALL laws restricting the 2nd amendment are Illegal and Unconstitutional. Every law restricting the 2nd amendment MUST be fought tooth and nail. Who is to say who is unstable? The government? Until 1967 even felons getting out of jail were given back their guns. Most felons (except gang bangers) get out of jail and go straight, most federal are for selling drugs, growing pot, not paying income tax, white collar crime, NOT bad people, just people who messed up and now lead law abiding lives. I know a few people like this. But if they get caught with 1 bullet they are looking at 5 years in Federal prison, this is BS. Now if you have a medical ID card for pot you are not allowed to own a gun. What’s next? You own a red car so you must be a mad person and can’t be trusted with a gun? EVERY law restricting guns rights MUST be fought tooth and nail. No exceptions!!!!!!!!!!!!!!!! Give them an inch and next year they will be back for more.   • Frankly its all window dressing. A criminal is not likely to go into a gun store to buy a gun. That criminal is more likely to go into a gun store to rob it, take the cash and some guns with ammo of course. I say again concerning the 2nd Amendment there are no: If’s, And’s, But’s, or Exceptions listed. In fact it states “…Shall not be INFRINGED.” So until there is another Amendment to the constitution that does establish exception’s, and so forth, All the laws ever passed over Gun Control are UNCONSTITUTIONAL. Remember an old saying, “Do it Right or don’t do it at all.”

    I’m with you labillyboy! In New York, they are trying to list anyone with mental issues as those who have or still do use prescription medications like prozac (depression/anxiety), ritilin and alderal (ADD or ADHD), ambien (insomnia) and other similar products. Do you have any idea how many people that would include that take or have taken these in the past? Insomnia considered mental health issue prohibiting gun ownership??? ADD?? Even depression does not typically cause someone to kill people other than possibly themselves. And you’re correct about the HIPAA privacy laws and doctor/patient laws. Perhaps that’s why under ObamaCare doctors are no longer to be called doctors but medical providers on the govt payroll. I personally signed a HIPAA form and noted that NO MEDICAL, PERSONAL OR FINANCIAL INFORMATION ABOUT ME OR ANY FAMILY MEMBER SHALL BE PROVIDED TO ANY FEDERAL AGENCY WITHOUT MY EXPRESS PRIOR AUTHORIZATION. It’s getting that bad!

    Seen where the Brady Act denied 2 million people guns but the vast majority the ATF didn’t consider a threat to society so they didn’t pursue.
    Both sides seem to be willing to spend millions to give people the illusion their safe from wacko’s but does nothing to address gangs or inner city crime. I live outside Philly and was told not to take a gun there even though I have a CCP but they seem to shoot people every night! Hummm guess they forgot to read and follow all those laws

    Better ‘background check’ plan.

    Once every quarter, every Sheriff in every county runs every Citizen in his jurisdiction.

    Then the FFL dealers in his jurisdiction runs 30 names for every gun purchase being made, 29 name at random, and the actual purchaser.

    If the purchaser comes back clean, they get the firearm, and nobody in government knows who bought what type of firearm.

    IF the name comes back as ineligible, the buyer gets to force the creator of the data base to PROVE the restriction in 30 days, or the name is removed from the restricted list.

    We should look at the crime rates where guns are mandatory. We don’t hear much about that now days do we? Mandatory Gun Ownership. And watch the crime rate go down. Not to mention, we are entering a dangerous time as a country and there may very well be a need for every citizen to be able to not only protect themselves but pitch in to protect this country from threats both foreign and domestic.

    I have a problem with the mental health as well, who determines what mental illness is? Some probably would believe that if you believe the Bible (i.e., in miracles, creation etc.) you must be mentally ill. Or if you believe that homosexuality and abortion are sin then you must be mentally ill. I see the potential of labeling pro-gun people as mentally ill in order to get around the Second Amendment.

    We need NO NEW GUN LEGISLATION what we need is to enforce what is currently in place. There is no amount of legislation that will stop criminals or the mentally unstable from committing a crime of any sort. We all would be best served if all LAW ABIDING CITIZENS carried a firearm. Here in the south were sane people live our crime rates have significantly dropped simply because the criminals do not know who does or does not have a firearm. Thank the CHL laws for this.

    The notion that more intensive background checks is a joke. Background checks have been in place for decades and have worked very effectively. If a person purchases a firearm from an FFL dealer whether at store front, over the internet or at a gun show an NCIS background check is performed. More often than not the person purchasing the firearm is put on a 72 hour hold and definitely will be if they any type of criminal history.

    Criminals have always skirted the laws and always will. There is no way to protect every person all the time much like driving a car every time one get behind the wheel of a car one takes a risk of being killed in that car. So have we banned cars? NO and we will not ban cars. The same goes for any type of daily activity anyone undertakes there is a risk involved in doing whatever one may do.

    Therefore in order to keep every person safe all the time DO NOT LEAVE YOUR HOME, NEVER GET OUT OF BED, DO NOT EAT, DO NOT SMOKE, DO NOT BREATH and we will all be dead inside of three months. Sound like a good plan? NOT!!!!!

    I don’t consider this new bill to be any better than the one just defeated in the Senate. The constitution says our rights to firearms will not be infringed. It doesn’t say that exceptions can be made for mental illness or for certain types of weapons. Our second amendment rights have already been infringed enough.

    In the USSR, a lot of people were sent to prison camps after being deemed mentally ill. Most of them simply did not agree with the communists in power. So being a free thinker, a true educator, a writer, or even hosting a gathering of like minded souls could put them in prison for years. “Your papers, please”.

    Any legislation that they propose MUST be scrutinized and evaluated by experts, not from the government. Those guys will say whatever their bosses tell them to, and their bosses will do the same all the way up to His Majesty and we all know where he is coming from.

    We must not allow anything to be passed that can be interpreted depending on what they want. Especially the mental health component of legislation. An example was expressed to me about a husband and wife thinking about divorce, they go to Marriage counseling and the husband expresses feelings of anger, the wife feelings of depression. If they so desired, some jerk up there in the DOJ could say both had been under mental health care and therefore added to this blacklist of ineligible to have any firearms. We all know Washington runs on technicalities left and right. It all depends on what they want to happen and right now the main agenda is to disarm as many of us as possible. No matter whether we are responsible gun owners or not. If they can make any of us “look unstable” on paper, that will be all she wrote for that person. It won’t matter if it is true or not. On paper, the person is crazy or unpredictable and therefore a danger to him/herself or others.

      The stuffed shirt reading the information would see 2 things on that paper, 1) A man and a woman are angry and depressed( which to the reader would mean that the man and the woman are both Angry and depressed) and 2) A doctor’s name. The reader would only see doctor, they would not bother to check further to see it was a marriage counseling, they would assume it was a psychiatrist or other mental health professional and deem the subjects unfit.

      Anyone care to disagree with my theory? It will be hard for anyone to insist on the government level of compentency in anything, let alone the 2nd Amendment.

    I can agree with parts of this but the mental health part still bothers me. The reason is
    that Vets are the ones who are targeted by the malcontents who hate the military and
    do not have the slightest clue about what stresses and trama that military members face
    daily when deployed. They are targeted by the politicans at ever twist and turn as a
    result. For what ever reason the politicos find military members both retired and active
    an easy target for thier attacks and claims of mental issues. I would suggest that we
    need to look at the politicos and some police depts for mental problems. Thier
    hatred of our laws and the U.S. Constitution seem to border on total obsession.
