Dems Propose Gun Fines

A contingent of liberal Democrats in Congress is proposing a new federal gun control idea: mandatory liability insurance for gun owners.

When New York Rep. Carolyn Maloney introduced the legislation last month with eight other Democrats, she boasted that it is “the first bill to require liability insurance of gun buyers nationwide.”

Maloney’s “Firearm Risk Protection Act” requires gun buyers to have “a qualified liability insurance policy” before they are able to legally purchase a firearm.

It also calls for the federal government to impose a fine as much as $10,000 if a gun owner doesn’t have insurance on a firearm purchased after the bill goes into effect.

“It shall be unlawful for a person who owns a firearm purchased on or after the effective date of this subsection not to be covered by a qualified liability insurance policy,” the bill text reads.

The bill would also make it a federal crime to sell a firearm to anyone without insurance.

    Since the right to bear arms is a constitutional right, I think it would just be an infringement to require any insurance coverage. There wouldn’t be any way to set any limits or minimums on premiums or benefits, and nothing could be done fairly. In reality, it would really be just a thinly veiled tax/penalty/fee that would primarily serve to infringe on the right. Sorry, but until we establish that insurance coverage is a Constitutional Protection, the world doesn’t have the right to force me to provide that benefit. It’s as if the US government needs to get an insurance policy for engaging in military/police activities. Can the government guarantee to make me whole should they somehow bring harm to me through the act of trying to protect the country? Then, under those rules, I think they will need a policy to protect ME. Or will they just need to be ordered by a court to pay restitution, like everyone else who injures someone? Stop the infringements!!

        Actually, I don’t think the amount is that large. Quite affordable, if you’re serious about using an auto. it’s just too bad we need a permit for every full auto gun.

    With such a proposal as requiring insurance for someone to exercise their 2nd Amendment right to own firearms, perhaps we could get someone to write legislation attaching an insurance indemnity to each of our other basic rights.

    In order to exercise your right to free speech, each citizen must have an insurance policy equal to the coverage mandated for firearms owners, such that if one were to carry $1 million in coverage for misuse of a firearm, he would also have to carry $1 million in order to speak or write anything, you know, just in case it libels or defames someone. Otherwise, he may not speak or write anything, not even birthday wishes to his granddaughter.

    All media outlets would be required to carry $1 trillion policies, since they have a greater likelihood to cause harm than a guy standing on a peach crate at the corner of 1st and Main.

    The 4th amendment would require that anyone who does not provide a list of safe combinations and passwords protecting electronic storage devices should have insurance to cover the cost of any forced entry by authorities to recover information or materials. Go ahead and lock it all up, but be prepared to cover the cost of extraction. Otherwise, if you don’t want to pay for insurance, all safes shall remain unlocked or safe combinations shall be engraved in a conspicuous location on the safes and either no passwords/encryptions may be used or all passwords/encryptions must be on file with local authorities.

    With respect to rights of trial, each person must have an insurance policy to cover whatever costs may befall him, regardless of verdict, including the paying of bribes in order to avoid a trial entirely. Those unable to provide such insurance can just rot indefinately in an undisclosed location, or until a relative comes forth with the required ransom for release.

    Yes, let’s give insurance companies something to do, now that they’re about to go out of the healthcare business.

    I read an better article the other day on this one. Some Insurance Companies were interviewed and they were not inclined to offer the insurance. So IF(and they shouldn’t for several reasons) they get this passed and no insurance companies offers a policy, How are tehy going to enforce it?

    I believe that any elected official, having taken an oath to support and defend the Constitution of the United States, who files, sponsors, co-sponsors, supports, or votes in the affirmative for any bill, resolution, or treaty that is in conflict with Constitutional provisions or amendments is guilty of treason and should be so charged.

        I just heard today somewhere that the affordable healthcare plan is probably going to be sued to end it due to the fact that it started in the Senate and according to The Constitution any taxable items must start on the Congressional side of the government. The Supreme Court ruled that it was a tax. I’m hoping that it gets shut down.

    “No State shall enter into any Treaty, Alliance, or confederation; grant Letters of Marque and Reprisal; coin Money; emit Bills of Credit; make any Thing but gold and silver Coin a Tender in Payment of Debts; pass any Bill of Attainder, ex post facto Law, or Law impairing the Obligation of Contracts, or grant any Title of Nobility.” Article 1 section 10 clause 1 of the United States Constitution.

    Yeah I know this is a 2nd Amendment issue, but it goes deeper than that. To fine a person for not having an insurance policy on a right, which is something that cannot be taken away unless adjudicated in a court of law, is a bill of attainder. Another example of this is the SCOTUS ruling on Obamacare, where people get penalized for not having or carrying health insurance….That too is a bill of attainder.

    Bill of attainder is defined by Black’s Law dictionary as “Legislative acts, no matter what their form, that apply either to named individuals or to easily ascertainable members of a group in such a way as to inflict punishment on them without a judicial trial.”

    This legislation is also grounds for federal Criminal lawsuits against those who support, vote to pass, and sign into law (Mr. Obama) as per title 18 USC sections 241 &242 (violation of civil rights under color of law)



    It’s time people get off their “duffs” and start holding these so called “elected leaders” accountable for their transgressions against We the People. Call their offices, email them, write letters, do whatever it takes within the scope of the law to make sure they know that this will not be tolerated and we have had ENOUGH!!!!

    And yes I am using my REAL NAME to post on here because I am not afraid of them. And NO ONE ELSE should be afraid of them either.

    The real winners if this bill becomes la are the trial lawyers I have a $1mil blanket liability policy now-It is dirt cheap(uner $130.00/yr) This bill would mean that anybody you caught on your proprerty and waved a gun at or his survivors could sue you for whatever reason(you scared me). Lawyers will be lined up to take these cases and Insurance will usually settle rather than fight. End result: insurance premiums go up and the bottom feeders get fatter. Jus gies them another target to after besides doctors, pharamecuticals, and medcal prothesis manufacturers

      Although vehicle ownership is a private choice driving on public roads is a privilege and each state has the right to issue requirements. Comparing driving to gun ownership is the proverbial apples to oranges. The Second Amendment clearly makes gun ownership a Constitutionally protected RIGHT of ALL Americans.

    This all comes down to one thing. These monsters MUST believe that they are royalty with the power to rule over us with an iron fist. To the contrary the constitution says they have governing authority and states that that authority originates with us (THE PEOPLE). A lot of the blame can be traced right back to us for not using due diligence. We voters see our elected officials taking more and more authority in tiny bites and taking away our rights in the same incremental way but they sprinkle a little sugar in the glass of bile they give us to drink in the form of food stamps,extended unemployment insurance or a jobs bill that favors our locality and suddenly the rights and or freedoms you just lost are forgotten. This has to stop! Senators, members of congress, the president and unelected officials alike need to be notified that they are not royalty,monarchs or dictators. We the people are the bosses and as the left wing feminists tell college girls:(NO MEANS NO.) When the people want to keep and exercise their right to keep and bear arms the government needs to shut their mouths and stop!! What is their answer? look for another way around our rights.When will it stop? I suppose when only the police, the military,and criminals have firearms!! Why do they refuse to stop their quest to disarm law abiding Americans? The only logical conclusion is that they actually have total dictatorial control over America as their ultimate goal but they must disarm us first to succeed.
