8th Grader Who Refused to Remove his NRA Shirt Could Face Year in Prison

Perhaps a suddenly firearm-friendly President Obama can put in a good word for Jared Marcum. In April, Marcum, an eighth-grader at Logan Middle School in Logan, W. Va., was arrested when he refused to take off his NRA t-shirt. The New York Daily News reports:

The clothing kerfuffle began when Marcum wore a shirt bearing the NRA’s logo and a hunting rifle. As he stood in line in the cafeteria, a teacher ordered him to either change shirts or turn it inside out.

Marcum declined and was sent to the office, where an officer was dispatched after he again refused to comply with the school’s request.

Cops arrested him and charged him with disrupting the educational process and obstructing an officer.

Late last week Marcum “appeared before a judge and was officially charged with obstructing an officer,” reports Fox News. If convicted, he could face up to a $500 fine or a year in prison. He will be back in front of the judge on July 11 if his attorney cannot get the charge dismissed before then.

One can understand this sort of silliness across the border in Maryland (as we have chronicled here and here) — but in West Virginia? This is, after all, the state whose senator’s campaign ad featured him shooting Obama’s cap-and-trade bill. Ah, those were the days.

    The teacher, school administrators, (so called) peace officer, and (so called) judge all need to be fired and put on public display. Where’s the ACLU??? Where’s the NRA legal team??? This has to be a sick joke. Move to Texas (or most other states) and this will never happen.

      Exactly! Where’s the NRA to back this kid up? He’s not only doing nothing wrong but, he was advertising for the NRA.
      The NRA should go after these anti-Constitution Scum and Not Stop until the charges are dropped and then, do Not stop going after the Teacher, the School Administration and the Pathetic Cop for violating the kids 1st and 2nd Amendment Rights. Come on NRA, do your job here!

    No;the school disrupted the school. If they had left him alone and let him express his First Amendment rights,this would have not happened. Call the American Center for Law and Justice.

    If this were my child, I would sue the school district for millions. This is a clear violation of the First Amendment, and I’m sure that a competent lawyer could find a host of additional violations.

    As a liberal I’m disappointed that the boys first amendment to free speech is under attack. The punishment is insane no liberal democracy should throw a person in prison for wearing a T shirt. The state of West Virginia has gone insane to throw children in prison for something so superficial I’m glad I don’t live their. The family should move if possible because clearly they don’t understand freedom.

    An 8th grader….what a 13 year old?????? …..arrested because he wears a T shirt to school promoting the NRA. How INSANE does this sound? I can’t be the only one who thinks this problem has gone way too far? This child’s family needs some competent legal representation so they can begin filing lawsuits. Otherwise, this insanity will continue…and spread, across this nation. The Obama Administration has taken everything that remained good in this country and have tried taking law abiding citizens rights away. The “VACATIONERS” and their corrupt friends who are trying to take our country away, need to be STOPPED and STOPPED NOW!!!
