Supreme Court: Requiring Proof of Citizenship to Vote is Illegal

The Supreme Court ruled Monday that states cannot on their own require would-be voters to prove they are U.S. citizens before using a federal registration system designed to make signing up easier.
The justices voted 7-2 to throw out Arizona’s voter-approved requirement that prospective voters document their U.S. citizenship in order to use a registration form produced under the federal “Motor Voter” voter registration law.
Federal law “precludes Arizona from requiring a federal form applicant to submit information beyond that required by the form itself,” Justice Antonia Scalia wrote for the court’s majority.
The court was considering the legality of Arizona’s requirement that prospective voters document their U.S. citizenship in order to use a registration form produced under the federal “motor voter” registration law. The 9th U.S. Circuit Court of Appeals said that the National Voter Registration Act of 1993, which doesn’t require such documentation, trumps Arizona’s Proposition 200 passed in 2004.
Arizona appealed that decision to the Supreme Court.
“Today’s decision sends a strong message that states cannot block their citizens from registering to vote by superimposing burdensome paperwork requirements on top of federal law,” said Nina Perales, vice president of litigation for the Mexican American Legal Defense and Educational Fund and lead counsel for the voters who challenged Proposition 200.
“The Supreme Court has affirmed that all U.S. citizens have the right to register to vote using the national postcard, regardless of the state in which they live,” she said.
The case focuses on Arizona, which has tangled frequently with the federal government over immigration issues involving the Mexican border. But it has broader implications because four other states — Alabama, Georgia, Kansas and Tennessee — have similar requirements, and 12 other states are contemplating such legislation.
Justices Clarence Thomas and Samuel Alito dissented from the court’s ruling.

The Constitution “authorizes states to determine the qualifications of voters in federal elections, which necessarily includes the related power to determine whether those qualifications are satisfied,” Thomas said in his dissent.

Opponents of Arizona’s law see it as an attack on vulnerable voter groups such as minorities, immigrants and the elderly. They say they’ve counted more than 31,000 potentially legal voters in Arizona who easily could have registered before Proposition 200 but were blocked initially by the law in the 20 months after it passed in 2004. They say about 20 percent of those thwarted were Latino.
Barbara Arnwine, president and executive director of the Lawyers’ Committee for Civil Rights Under Law, called the decision a victory. “The court has reaffirmed the essential American right to register to vote for federal election without the burdens of state voter suppression measures,” she said.
But Arizona officials say they should be able to pass laws to stop illegal immigrants and other noncitizens from getting on their voting rolls. The Arizona voting law was part of a package that also denied some government benefits to illegal immigrants and required Arizonans to show identification before voting.
The federal “motor voter” law, enacted in 1993 to expand voter registration, requires states to offer voter registration when a resident applies for a driver’s license or certain benefits. Another provision of that law — the one at issue before the court — requires states to allow would-be voters to fill out mail-in registration cards and swear they are citizens under penalty of perjury, but it doesn’t require them to show proof. Under Proposition 200, Arizona officials require an Arizona driver’s license issued after 1996, a U.S. birth certificate, a passport or other similar document, or the state will reject the federal registration application form.
While the court was clear in stating that states cannot add additional identification requirements to the federal forms on their own, it was also clear that the same actions can be taken by state governments if they get the approval of the federal government and the federal courts.
Arizona can ask the federal government to include the extra documents as a state-specific requirement, Scalia said, and take any decision made by the government on that request back to court. Other states have already done so, Scalia said.
The Election Assistance Commission “recently approved a state-specific instruction for Louisiana requiring applicants who lack a Louisiana driver’s license, ID card or Social Security number to attach additional documentation to the completed federal form,” Scalia said.

Mexicans come here because they “know” they have more rights than American Citizens (Yes; they do comprende, that’s why they’re here). I heard it said that the Mexican Government tell it’s Citizens to do this.

      Another fact; Many if not most, illegal alien Mexican woman come here near the end of a pregnancy so they can give birth in America (before they can be deported so, their child becomes a Citizen and they themselves will not be deported. I heard this “so called” law, was made only because of and for African Slaves, NOT Mexicans.

      Anyway, it’s perfectly clear that obama and his puppet masters own this Supreme Court, which means the court is going to do any and all it can to make sure illegal aliens can vote, to ensure the Democraps remain in office to continue their Constitution shredding efforts.

    I completely understand with my fellow Conservatives and the demand for showing proof of citizenship in order to vote however, as a very conservative Mexican-American myself, I don’t appreciate the above picture to portray Mexicans. (and yes, this is an insult to every Mexican, illegal or not). Just like every other race groups, you have the degrading ones who act like fools like the above ones in the picture. This decision made by the Supreme Court isn’t for equality at all. I know that it is a tactic the Obama administration is using to lure the Hispanic, minority vote! But not all of us Hispanics are dumb enough to fall for it! I still don’t like him or anything he stands up for!

    Well, I guess its official. The SCOTUS is now dead. It is irrelvent and has violated the law, the highest law of the land, the Constitution. My only question is when and who goes in and arrests the justices who voted that non-citizens can decide the internal workings of the United States. According to the Constitution only legal citizens can vote on elected representatives and what legislative laws are made.

    Also you can now add the United States of America to the obituary. Without the protection of the Constitution, which was just invalidated, the country is now open to any country who wants to walk in and take it over, no shots fired.

    Time to leave or fight. Which is it America???

    In his ‘fictional’ book he had this same scenario except he had the supreme court 5-4 and it was printed in 2006. It is very eerie how correct that series really is and is becoming. If the book is remotely correct we are in for a world of hurt! I cannot even believe it is like bizzarro world that the Supreme court would say making sure people are a citizen is illegal, how is that even close to being right.       No. It allows that during your registration process (and many other gov’t processes) that you be offered a way to register for the vote at the same time. The federal gov’t mandated that several years ago. They directed the states to set up this system. Screw that.
      Go back to the old way, where voter registration is a thing you do by itself. Don’t join it onto anything else.
      When your kid turns 18, say ” son/daughter, I’m taking you down to the courthouse where you can register to vote “, then go and do it. Don’t let the gov’t dictate how you do it. They work for us. Not us for them.

    1. The Supreme court is not the final decider of what is constitutional. No one branch of government has that ability and there is such a thing as nullification. 2. The problem starts with motor voter, so it’s time to get rid of it. 3. The states can still try other methods to prevent voter and need to. 4. From what I’ve read, real citizens have been injured, so to speak, by additional voter registration requirements, so we have problem. This of course, takes us back to motor voter where the real problem begins. Whoever gets the white house next, and Shrillary is not a shoe in, he or she will have an extremely busy first term fixing the mess which is this country. Remember, there is NO fixing our problems from the top down. Focusing solely on national races and blindly believing that if we just get so and so into office in Washington all our problems will be solved is exactly how we got where we are. The real solution lies in state and local elections. Yes, we want to turn over the muck in D.C. but the real work is state and local.

        I intend to email this picture to every person on my email list. I am going to email every Representative and Senator and ask that they vote no on all the immigration laws unless and untill the existing 1986 immigration law is enforced, especially where it is against the law for any employer to hire an undocumented or illegal worker, who cannot prove that he is legally allowed to work in this country. How can you support a new law when the government won’t enforce the key provision of the existing law? I have followed that law for the eleven years that I have been in business. Einstein’s definition of insanity it to do the same thing over and over and expecting a different result. How hard is it to enforce the law?

    Ok Supreme Court, all states should require a separate registration for just state elections. If you are a resident citizen of the state, you must proof citizenship of the state and show your photo I.D. when voting in state or local elections. Voting machines could be programed for federal voting only, if you don’t show I.D. That would seem to satisfy the Supremes. And for both (state & fed) if you do have I.D.

    This crap is what we have already fought one civil war over! The rights of the states to govern themselves. The solution is for Arizona and other states to not participate in federal elections. No participation, no person elected from those states to go to D.C. Therefore, they don’t have to worry about the taxation without representation because they are not sending anyone there to cheat them. All of the money the fed sends the states goes away but then all the money the states send the fed stays in the states. No more gasoline tax sent to uncle nobama, no more road taxes paid to auntie mochelle, no more of any state money going to federal programs and let the states support themselves which can’t be any worse than it already is. This eliminates the food stamp programs and other federal intitlement programs which are largely funded by federal funds so people have to get off their a**es and get a job which means more money in the state coffers from the workers taxes kept by the states. Yes, this sounds crazy and I am sure I will catch all kinds of hell for my comments but if we don’t participate, we don’t have to listen to the federal gubmint. Let the state’s rule themselves and eliminate the federal gubmint altogether.

      Probably wouldn’t work for just one state. The feds would put the strangle hold on them. But, if several states joined a similar cause, it would start a second civil war. But, I’m ready. I’m moving to Arizona soon anyway. Might just have to step up my plans.

      Go back and read the dissenting opinion. It explains it all, very simply. The states decide who is eligible to vote in federal election. After reading the dissenting opinion, go to the Constitution itself, and find the same statement. It is clear as crystal.

    I stand with Arizona as well. No illegal immigrant should be allowed to taint the voting by being allowed to vote. In any way, shape or form. They are not U.S. citizens, therefore should not have any say whatsoever as to who is elected to public office. This is an Obama owned Supreme Court intimidated by the Obama Administration and Obama himself, who are making decisions that slant toward what Obama wants and no other driving force is considered here. it is his permanent voting caste to keep Democrats elected to the Presidency. “The gimme free stuff people”. He is pretty much allowing these parasites to come into the country uninhibited by our immigration laws and now they are uninhibited by our voting laws too.
    Can’t run a country just by being able to pick pineapples, tomatoes and landscaping. Working on road crews illegally isn’t going to cut it either.

    As a resident of AZ, a senior, and a vet, I have to ask, how come I had to prove to the US government I’m a citizen to VOLUNTEER for the military, back in the ’60s, to PROVE I’m a citizen when I registered to vote the 1st time, and every time I’ve moved from one state or county to another, not just my word or a post card, but SHOW PROOF of my citizenship? The last several times I’ve moved have been within the same county, so not required showing proof other than of my place of residence, because I was already registered IN that county. But then 3 times in the past 30 years the voters of this state have approved English only as the official language, and we STILL have to press one for English, and EVERYTHING is printed in Spanish, as well, or sometimes exclusively!

        So did I; but the passport I do understand, that has to do with national sovereignty, and insuring those who come in are legal to do so, meeting all the extant requirements, when they’ve been outside the national boundaries. The rest are INSIDE our nation, and really don’t make sense except to prevent those not eligible from participating in certain activities. The National ID and biometric chip thing I do question strongly, however, which is buried in the “immigration reform”.

    Insanity……the Justices who don’t “think”– should be impeached. ALL Laws must be “Reasoned”—otherwise, they are unjust and arbitrary which makes them unconstitutional.

    Any laws that promotes Vice are unconstitutional since Justice is a Virtue and Vice can never be promoted by “Just” laws. Only “Just Law” is Constitutional.

    As all the Founders/Justice Marshall stated—any laws that go against “Right Reason according to Natural Law” are unconstitutional…..no laws—absolutely NONE—can be antithetical to the Supreme Law of the Land—-and still be Constitutional.

    It’s ridiculous that, to simply buy a shotgun to hunt or handgun to protect my family, I cannot get by (without registering for a federal permit to speed it up) with a simple NICS background (dozens of questions)check without weeks of red tape and ‘Delay’. Yet for a lawbreaker (i.e. a criminal) who may or may not even pay taxes for privileges I pay for (but never have collected), is allowed to have a say in implementation of American Laws of Liberty (or destruction thereof), when they (illegal criminals) don’t even have a claim to MY country!?!?!?

  • OK, the nine want to do this? OK. Then we need to split the vote into a federal vote and a State vote. One ballot will be for state offices and one will be for Federal offices. You
    have to prove citizenship to vote in the state election and then you cross the room to vote in the federal election. The feds have no say in the state election as long as all citizens are treated equally. But this mostly applies to the “motor – voter” law. Why don’t we go back to you have to go and register at least 60 days before the election?
