Florida to Expand Stand Your Ground Law

Florida state legislators are a step closer to expanding their Stand Your Ground law to include the ability to legally fire a warning shot. The expansion being considered “would grant the same protections already in place under Florida’s ‘Stand Your Ground’ law to people who only threaten to use force.”

If the expansion takes place, law-abiding citizens who fire a warning shot “would be immune from Florida’s ’10-20-Life’ law, which requires anyone who shows a gun while committing certain felonies…be sentenced to 10 years in prison.” If someone is wounded, the “10-20-Life” law requires a sentence of 25 years to life.

According to Fox News, a state Senate committee “voted in favor of the bill (SB 488) on [January 8] and a house committee has… voted in favor of similar legislation (HB 89),” as well.

The push to expand the “Stand Your Ground” law is partially due to the plight of Marissa Alexander, who was sentenced to 20 years in prison after firing a warning shot during an argument with her estranged husband.

Her sentence was “thrown out by an appeals court,” and a new trial scheduled for this year.

In pressing for the expansion to include warning shots, state Senator Greg Evers (R-Baker) said the legislature is not going to put up with law-abiding Floridians being punished if they “brandish weapons, [and] even fire warning shots, to ward off would-be assailants.”

    Good the sooner the better, I fired a warning shot once and the cops came and crewed me out for shooting in the air, said next time shoot into the ground or the person who was giving me a problem.

            The cops could have given me a ticket but instead gave me some good advice, shoot into the ground or one of the attackers and won’t be in trouble. Good advice but they wanted into the house where my family was. Were 6 of them and had clubs and chains, that is what made me not think right. God Bless Friend:

          Pipelines are way to deep for a bullet to penetrate the ground Unless you for some odd reason have your House gas line running too shallow which would be out of compliance for local codes in most cases!

          how far do you think a handgun would shoot into the ground? 3-4in’s tops if there is a gas line there, than it should blow up for being so close the the surface ,, to be even more frank if the ground is hard it would not go that far.

      It’s not always a safe bet to fire into the ground either. If the only ground available is covered with concrete and asphalt, the unintended ricochet effects become a safety hazard.

        I know that for sure, had a friend who always talked gun safety and one day while out he fired at a can and the rock behind it bounced and I had a bullet threw my lift arm. He about passed out when I showed him my arm and the blood, LOL. I was a instrutor in the Marine Corps and know what can happen, the day that I got foolish was un-called for and know better today. If I would have fired into the ground I know it was all grass and the cops were right and glad I didn’t get a ticket but with all the law suits today I don’t know if I would shoot any of the six gang members? Instead of them being the problem all of a sudden the man with the gun becomes a problem and that is wrong. Had a man sitting in his yard killed by someone shooting in the air blocks away and should have known better, when confronted we some times don’t think and I thank you for your comment jaws4316 as it was a wise comment.           You can never be too careful with guns. A couple of years ago a 13 year old Amish girl died when a local hunter fired his gun in the air to empty it before legal daylight expired. She was a mile and a half away from where he was standing. It took some time and investigation before they figured out what happened. Personally, I think it’s pretty stupid of the State of Ohio to make it illegal to carry a loaded gun in the woods after legal daylight hours. It would be better if they passed a law against firing a rifle in the air.

        Better to shoot into the ceiling. Chances are the layers of sheet rock, plywood or the rafters will stop the bullet or at least slow it down so it does not become a hazard

        1) Lawyers arguing that if you had the time and the frame of mind to fire a “warning” shot there was no real immediate threat to begin with. 2) Idiots taking pop shots at anything and everything in the name of a warning shot.
        3) Innocent bystanders being struck by “warning” shots because the people are scared and in their attempt to scare off the attacker aren’t paying attention to where their warning shot is placed.

        If I were an expert and had a little time to think about it I’m sure I could come up with a few more.

        P.S. I’m 150% for stand your ground and other self-defense laws but I’m of the “shoot center-of-mass to stop the threat” philosophy.

        I am 150% for good people carrying guns for self-defense pretty much anywhere and anytime. I am also 150% against so-called “warning” shots. If there is a reason to draw my weapon, which I have carried concealed daily for years, I will be shooting center mass to stop the threat. Where do you propose, sir, the warning shot be that will be in a safe direction?

However, to ANYONE ever considering firing off a warning shot, DO NOT fire into the air, fire into the ground as close to you as possible w/o pointing it in the direction of someone else, unless you intend to shoot them.     The woman that was sentenced to prison, got what she deserved. When she left the home and went to her car to get the gun, she became the aggressor. Once she retreated and was out of danger, she should have called the police and not went back inside with the gun.

    Personally, I always go with what my Grandpa taught me. That is “Don’t ever pull a gun unless you intend to kill somebody.” If I’m attacked or someone breaks in my house and I feel threatened to the point of using a gun, they aren’t going to be around to testify against me, or try to sue me.

      I personally do not want to shoot anybody! I will if I have to but given the chance to scare away a would be attacker with a warning shot INTO THE GROUND I will. George Zimmerman’s life was ruined and he can’t even roll a stop sign without it making the national news. Who wants that? Generally just pulling a weapon does the trick. If on the other hand I am in fear of death or great bodily harm then I would shoot INTO the PERPETRATOR!

        I can see your point, but the Zimmerman case is probably not very relevant to a debate about warning shots. Zimmerman wasn’t in a situation where warning shots were even a consideration. He shot a thug who was on top of him and beating the hell out of him, because he believed he was going to be killed if he didn’t. Then he was victimized because of racial tensions and left wing anti-gun sentiment.
